Competition Terms and Conditions

1. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon individual creative merit. All entries must be an independent creation by the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.

2. The promoter is The Lane Creative Enterprises, trading as The Lane, ABN 48127479412 (the “Promoter”).

3. The competition is open to residents of all countries, aged 18 years or over except employees of The Lane, their close relatives and anyone otherwise connected with The Lane or judging of the competition.

4. There is no entry fee and no purchase necessary to enter this competition.

5. The Competition commences on 20th May 2019 at 6:30am Australian Eastern Standard Time (AEST) and closes on 20th June 2019 at 11:59pm AEST.

6. By entering the competition, all entrants will be deemed to have accepted and agreed to be bound by these rules.

7. To be eligible to enter, during the Competition Period entrants must:

a) Follow @the_lane, @emirates and @atlantisthepalm on Instagram

b) Tag your partner in the official competition post, and comment 25 words or less describe why you want to travel in luxury via Emirates’ business class to your dream destination.

8. The Promoter reserves the right to disqualify any entry, if:

a) Entry does not comply with these Terms and Conditions.

b) Entry contains inappropriate or offensive content as deemed so by the Promoter. This includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The promoter’s’ decision will be final and no correspondence will be entered into.

1. Entrants warrant that their entry does not infringe the rights, including the intellectual property rights, of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use and modify their entry (including, without limitation, by re-sharing the entrant’s post) for the purposes of the Promoter’s business including for promotional purposes without the payment of any further fee or compensation. If requested by the Promoter, the entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement.  To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.

2. Entries must be completed during the Competition Period.  Entries completed after the end of the Competition Period will not be accepted.

3. Entry is limited to one entry per individual Instagram account.

4. Prize is two (2) Return Emirates Business Class flights to Dubai,and 1 x night stay in an Imperial Club Deluxe King room inclusive of access to Aquaventure Waterpark, and the Lost Chambers Aquarium, access to Imperial Club including daily afternoon tea, evening cocktails and canapes and finally a private Cabana at pool, beach and Aquaaventure. 

5. The prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. Prize cannot be exchanged. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

6. The promoter shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for personal injury which is suffered or sustained, in connection with the prize, except for any liability which cannot be excluded by laws.

7. Judging will take place on June 21stat 8am AEST. The judging will be carried out by The Promoter.

16. The Promoter may select additional reserve entries that they determine to be the next best in the event of an unclaimed prize or an invalid entry or ineligible entrant being selected as the winner.

17. The winners will be notified on June 22nd 2019 via a comment from @the_lane on the winning Instagram post entered and an exclusive Instagram post to announce the winner. The winner must respond by contacting The Lane by Instagram private direct message with their email and phone number within seventy-two (72) hours after they have been notified by the Instagram comment on their post. In the event that the winner does not contact The Lane within seventy-two (72) hours of being notified by the Promoter that they are the winner, their entry will be deemed invalid and the Promoter may award the Prize to a reserve entry.

18. The Promoter is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website or Facebook or Instagram, or any combination thereof including, but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials in this Competition. Promoter assumes no responsibility for any failure to receive an entry as a result of technical issues.

19. The winner agrees to the use by The Lane of his/her name and image in any publicity material, as well as their entry.

20. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from entrants relevant to entry into or participation in this Competition.  Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise is involved in any way in manipulating, interfering or tampering with the conduct of this Competition.

21. Entrants and participants in the Competition acknowledge that the Competition is in no way sponsored, endorsed or administered by or associated with Facebook or Instagram and entrants and participants in the Competition release Facebook and Instagram and its associated companies from all liability arising from the Competition. Entrants provide their information to the Promoter and not to Facebook or Instagram.

Emirates Flight Prize Terms & Conditions

Emirates flight tickets (“Flight Tickets”) are valid on Emirates only and are non-extendable, non-transferable, non-re-routable, non-endorsable and non en-cashable. Flight Tickets shall at all times be subject to availability, capacity controls and Emirates Conditions of Carriage and applicable ticket conditions as set out on the Emirates websiteand seats may not be available on all flights. Flight Tickets are not valid for bookings on partner airlines or code share or interline flights or for use in connection any other products or services. The winner and where applicable their guest must travel together on the same dates / sectors on both outward and return journeys. If a winner or where applicable the guest is unable to utilize the Flights Tickets no cash alternative will be provided.  All travel documentation and visas must be up to date and are the responsibility of the winner and where applicable the guest. Flight Tickets do not include access to the Emirates Lounges. Skywards miles are not accruable on the flights.

Nothing in these Official Rules requires Emirates to provide transportation to any person except in accordance with:

• Emirates General Conditions of Carriage for Passengers and Baggage and travel documents, including airline tickets and airway bills, issued by Emirates;

• Emirates Schedule of Operations in place from time to time; and

• the relevant immigration rules applicable to any ticket holder.

Except in accordance with and subject to the limitations set out in the Warsaw Convention 1929 (as amended by the Hague Protocol 1955), the Montreal Convention 1999, and its travel documents (including but not limited to airline tickets and airway bills), Emirates accepts no liability to any person for any liabilities, losses, claims, demands, costs or expenses arising directly or indirectly from the utilisation of Flight Tickets provided pursuant to the Promotion.

Government taxes and fees which apply to travel booked on an Emirates Flight Ticket, are the responsibility of the passenger, and will vary based on route. Government taxes/fees are subject to change as required by law. Passenger is solely responsible for fees for oversized, overweight or extra baggage and fees for products/services sold separately.  Passenger must pay all applicable taxes and fees at the time of booking.

The winner and where applicable their guest will be responsible for all other costs and expenses associated with redeeming the Flight Tickets including but not limited to travel insurance, airfares, food, accommodation transfers (other than as provided hereunder) and any other ancillary costs associated with redemption of the Flight Tickets.

Atlantis, The Palm Prize Terms & Conditions

Accommodation cannot be re-gifted or cashed in and is non-transferable.

The prize for 1 x voucher for one couple to enjoy a 1 x night stay at Atlantis, The Palm Dubai in a Deluxe King room (ocean or palm) inclusive of:

Access to Aquaventure Waterpark and The Lost Chambers Aquarium, Access to Imperial Club which unlocks multiple complimentary VIP inclusions such as VIP check-in, private beach access, daily afternoon tea and evening cocktails and canapes, Private Cabana at pool, beach and Aquaaventure. To be booked before 1 April 2020, blackout dates applied and include 5-20 April 2019, 19-26 October 2019, 22-31 December 2019, 1-5 January 2020, 4-17 April 2020, 24-31 October 2020 and 26-31 December 2020. To note, these dates are subject to change. The Ocean and Palm rooms are both considered Deluxe King rooms. The only difference between the two are the views, one looks over the palm and one looks over the ocean, subject to availability.

Entrants under eighteen (18) years old must obtain parental consent prior to entry. Employees, officers and directors of Atlantis, The Palm Limited and Kerzner International Limited (together the “Sponsor”) and any of their parent and affiliate companies as well as immediate family and household members of each such employee, officer and director are not eligible. The Contest is subject to all applicable laws and regulations and is void where prohibited. Participation in this Contest constitutes entrant’s full and unconditional agreement to these Rules and Sponsor’s decisions, which are final and binding in all matters related to this Contest.

Prizes are non-transferable and no substitution will be made. Any unused portion of the prize will be forfeited, no cash substitutions are allowed and cannot be combined with any other offer or promotion. Sponsor reserves the right to substitute a prize if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and personal expenses, visas, personal expenses and travel insurance. A valid credit card imprint may be required upon arrival to guarantee payment of extra charges.

By receipt of any prize, each entrant and winner agrees to release, indemnify and hold harmless Sponsor and its respective affiliates, officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or possession, acceptance, receipt or use or misuse of any prize and for any claims based on copyright, trademark, publicity rights, false endorsement or association, defamation, invasion of privacy or any other intellectual property-related cause of action and/or merchandise delivery. Sponsor is not responsible if Contest cannot take place or if any prize cannot be awarded due to cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism or any other reason outside Sponsor’s reasonable control.

Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any virus, bugs, non-authorized human intervention, fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Contest or to be acting in violation of the Rules or in a disruptive manner.

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved exclusively by the DIFC Courts in Dubai in accordance with Dubai laws. By participating in the Contest, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted such privacy policies.
