1. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon individual creative merit. All entries must be an independent creation by the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.

2. The promoter is The Lane Creative Enterprises, trading as The Lane, ABN 48127479412 (the “Promoter”).

3. The competition is open to residents of all countries, aged 18 years or over except employees of The Lane, their close relatives and anyone otherwise connected with The Lane or judging of the competition.

4. There is no entry fee and no purchase necessary to enter this competition.

5. The Competition commences on 16 December at 8PM Australian Eastern Daylight Savings Time (AEDT) and closes on 23rd December 2022 at 10AM AEDT.

6. By entering the competition, all entrants will be deemed to have accepted and agreed to be bound by these rules.

7. To be eligible to enter, during the Competition Period entrants must:

   a) Follow @hardybrothers and @the_lane on Instagram

   b) Provide your best contact details in the giveaway form to subscribe to The Lane Journal and Hardy Brothers’ updates.

   c) Comment in 25 words or less in the giveaway form why you deserve to win a Hardy Brothers Diamond Tennis Bracelet.

8. The Promoter reserves the right to disqualify any entry, if:

   a) Entry does not comply with these Terms and Conditions.

   b) Entry contains inappropriate or offensive content as deemed so by the Promoter. This includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The promoter’s decision will be final and no correspondence will be entered into.

9. Entrants warrant that their entry does not infringe the rights, including the intellectual property rights, of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and license to use and modify their entry (including, without limitation, by re-sharing the entrant’s post) for the purposes of the Promoter’s business including for promotional purposes without the payment of any further fee or compensation. If requested by the Promoter, the entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement.  To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.

10. Entries must be completed during the Competition Period.  Entries completed after the end of the Competition Period will not be accepted.

11. Entry is limited to one entry per individual.

12. Prize is one Hardy Brothers 2.00ct Diamond Tennis Bracelet valued at $4,900 AUD.

13. The prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. Prize cannot be exchanged. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

14. The promoter shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for personal injury which is suffered or sustained, in connection with the prize, except for any liability which cannot be excluded by laws.

15. Judging will take place on December 23rd at 10am AEDT. The judging will be carried out by The Promoter.

16. The Promoter may select additional reserve entries that they determine to be the next best in the event of an unclaimed prize or an invalid entry or ineligible entrant being selected as the winner.

16. The winners will be notified on December 23rd 2021 via the email and phone number submitted in the competition form. The winner must respond by contacting The Lane by email and phone within seventy two (72) hours after they have been notified by The Lane. In the event that the winner does not contact The Lane within seventy two (72) hours of being notified by the Promoter that they are the winner, their entry will be deemed invalid and the Promoter may award the Prize to a reserve entry.

17. The Promoter is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website or Instagram, or any combination thereof including, but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials in this Competition.  Promoter assumes no responsibility for any failure to receive an entry as a result of technical issues.

18. The winner agrees to the use by The Lane of his/her name and image in any publicity material on Instagram, as well as their entry answer.

19. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from entrants relevant to entry into or participation in this Competition.  Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise is involved in any way in manipulating, interfering or tampering with the conduct of this Competition.

20. Entrants and participants in the Competition acknowledge that the Competition is in no way sponsored, endorsed or administered by or associated with Instagram and entrants and participants in the Competition release Instagram and its associated companies from all liability arising from the Competition. Entrants provide their information to the Promoter and not to Instagram.
